This Privacy Policy (“Policy”) explains and governs the manner in which Paragon Global Markets, LLC dba Fanatics Markets IB together with its related, affiliated, parent, or subsidiary companies (collectively referred to herein as “Fanatics Markets IB” “we,” “our,” or “us”), collects, uses, discloses, and otherwise processes information related to your use of our website, mobile applications, social media accounts, digital platforms, or other online services (collectively “Services”). The Services are intended for use by those present in the states in which we operate in the United States (“U.S.”) in accordance with U.S. laws, the Terms of Service and this Policy.

When we refer to “you” or “your” in this Policy we mean any individual who interacts with or uses our Services. By accessing and using the Services, you represent that you understand and agree to this Policy, and consent to the collection, use, disclosure, and sharing of information as described in this Policy. If you do not consent to our practices, you can choose not to use the Services.

By registering with Fanatics Markets IB, you are creating a Fanatics ONE account, which can be used to log in to all of Fanatics’ online platforms.  Your Fanatics ONE account is subject to the Fanatics ONE Privacy Policy, which is incorporated herein.

  1. Personal Data We Collect We may collect, use, store, and disclose different kinds of information that is linked or reasonably linkable to an identified or identifiable individual (collectively referred to herein as “Personal Data”). Information that we collect may depend on how you interact with us and use the Services. A description of the types of information we may collect is described in detail below.
    1. Identifiers, such as name, online identifier, gender, profession, social security number, driver’s license number, passport number, or other government-issued identification document.
    2. Contact Information such as your email address, mailing address, and telephone numbers.
    3. Financial Information such as financial transaction history, credit history, tax information and credit scores. 
    4. Profile Data such as your username and password and your interests and preferences. 
    5. Commercial Information such as records of products or services purchased, obtained, or considered, trades made, survey responses, or other purchasing or consuming histories or tendencies.
    6. Characteristics of Protected Classifications Under California or Federal law, including age or date of birth, national origin, citizenship.
    7. Biometric Information, including faceprints (i.e. your face geometry) to verify your identity, which is collected by our vendor. Biometric information shall be treated as sensitive Personal Data as described below. See the Biometric Information Policy below for additional details.
    8. Usage Data includes information about how you use our Services, such as statistics regarding the opening and clicking on emails, and activity on the website (user’s activity, time spent, user stats, referring/exit pages, and clickstream data), or how you otherwise engage with us. 
    9. Internet or Other Electronic Network Activity Information, including browsing history, search history, and information regarding your interactions with a website, application, or advertisement, including IP address, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access our services.
    10. Marketing and Communications Data such as marketing campaign data, click throughs, your preferences in receiving marketing from us and our third parties, your communication preferences, email communications, and chat communications.
    11. Audio and Visual Information such as audio or video recordings and photographs.
    12. Location Data, such as precise geolocation data through GPS, Wi-Fi, wireless network triangulation, or other methods.  
    13. Inference Data including inferences drawn from the Personal Data identified above.
    14. Sensitive Personal Data. We collect Personal Data that may be considered sensitive Personal Data or sensitive data under state privacy laws, including social security number, driver’s license, passport, or other government-issued ID, national origin, citizenship, precise geolocation, and biometric information. We do not use or disclose sensitive Personal Data or Data for any business purposes other than as permitted by law, including providing you with the goods and services you request, verifying your identity, ensuring security and integrity of our websites and apps, complying with applicable legal requirements and/or as permitted by further regulations. 
  2. Biometric Information Policy Fanatics Markets IB uses third-party technology through its vendors to collect, store, and use biometric information, such as your faceprints (i.e. your face geometry), along with other Personal Data like a selfie, and government-issued ID.  These identity verification vendors may vary depending on your state of residence, and include Socure or Aristotle.  By using our Services, you consent to Fanatics Markets IB, our identity verification vendors, and each of our contracted service providers, collecting, storing, and using your biometric information for the purposes identified below and as set forth in and Privacy Policies.  Purpose for Collection of Biometric Information. Fanatics Markets IB and its vendor may use biometric information for the following purposes:
    • To verify your identity
    • To prevent fraud
    • To improve products and services
    • To comply with legal obligations  Data Retention. Biometric information will be securely deleted no later than 3 years after your last interaction with us or our vendor, whichever happens first, provided we have no other legal obligation to retain such information for any longer period
  3. How We Collect Personal Data We may collect Personal Data from a variety of sources and methods. This includes:
    1. Directly From You.  We may collect Personal Data during your access or use of the Services, such as when you:
      1. Create or verify an account;
      2. Purchase goods and/or services;
      3. Participate in a promotion, survey, and/or contest;
      4. Communicate with us by mail, phone, email, or otherwise engaging with us;
      5. Make a deposit or withdrawal;
      6. Engage with our Fanatics Family of Companies; or
      7. Otherwise completing a form or sharing your personal data with us.
    2. Information We Collect When You Use Our Services
      1. Automated technologies or interactions. As you navigate around our Services (whether or not you have created or have logged into a user account) and/or use the Services, Fanatics Markets IB may collect certain information using various technologies to help us personalize your experience. This information may include internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, time zone setting and location, language preferences, device type and ID, and other technical information from the devices you use to access our Services.
      2. Cookies and Tracking Technologies.  We and our service providers use cookies, pixels, and other tracking technology to recognize your browser or device and to capture and remember certain information about your activities on our website.  For example, cookies gather information about how long you spend on a web page so that we can understand what web pages are of interest to users. If you prefer, you can choose to have your computer warn you each time a cookie is being sent, or you can choose to turn off cookies by adjusting your browser settings. If you turn off your cookies, some of the features of the website may not function properly. You can also generally opt-out of receiving targeted ads from third party advertisers and ad networks who are members of the Network Advertising Initiative (NAI) by visiting .  You may opt-out of receiving targeted advertisements from other companies that perform interest-based advertising services, including some that we may work with, via the Digital Advertising Alliance (DAA) site at . When using the ad industry opt out tools described above, note that if you use multiple browsers or devices you may need to execute this opt out on each browser or device.  Additionally, we do not make any representations or warranties about such opt-out services. Such services are independent from us, and we have no control over, or responsibility for their performance. Pixel tags generally work in conjunction with cookies, registering when a particular device visits a particular page. You cannot decline pixel tags; however, if you turn off cookies the pixel tag will simply detect an anonymous visit. In addition, we use pixel tags in our HTML-based emails to let us know which emails have been opened by the recipients. This allows us to gauge the effectiveness of certain communications and the effectiveness of our marketing campaigns. If you prefer not to be tracked through our emails, most email services will allow you to turn off pixels by disabling external images in settings.
      3. Analytics.  We use third party cookies provided by Google Analytics to assist us in better understanding our visitors. These cookies collect IP address and usage data, such as the length of time a user spends on a page, the pages a user visits, and the websites a user visits before and after visiting our Services. In addition to reporting usage statistics, Google Analytics can also be used to help show more relevant ads on Google properties (like Google Search) and across the web.     3. Information We Collect from Third Parties
      1. Service Providers. We collect Personal Data from service providers including email service providers, website hosting platforms, third party identity verification, analytics, and geolocation service providers.
      2. Social Media Services.  When you create an account using your Google or Apple login we receive Personal Data from those third parties, which may include your public profile information and email.
      3. Third Party Advertising Partners.  We collect Personal Data received from third party advertising partners, including partners who host and manage various online advertisements and ad platforms.  This may be combined with the website analytics data described above.
      4. Data Brokers.  We may collect information from third party data brokers.  the categories of Personal Data we obtain in this manner may include your contact details, demographic information, commercial preferences, and online activity data. We use this information to better understand our customers, tailor our services and marketing, detect and prevent fraud, and for other business purposes described in this Policy.
      5. Publicly Available Information.  We may collect Personal Data from publicly available sources that provide information to us, government and other public sources, and social media platforms and networks. Under applicable laws, you may have the right to know which categories of Personal Data we collect from third party sources, to request a copy of this information, or to opt out of certain uses, including the “sale” or “sharing” of your Personal Data, as defined by law. To exercise these rights, please see the “Privacy Rights” section below.
  4. How We Use Personal Data Our primary purpose for collecting your information is to provide you with the products and services you request. We may also use your information for the following purposes:
    1. To provide you with products and services, such as to:
      1. Assist you with setting up and managing your account with us;
      2. Facilitate transactions  and other similar interactions; 
      3. Verify your identity and account information in connection with our Services you request; 
      4. To help the government fight the funding of terrorism and money laundering activities, Federal law requires us to obtain, verify, and record information that identifies each person who opens an account.  What this means for you: When you open an account, we will ask for your name, address, date of birth and other information that will allow us to identify you. We may also ask to see your driver's license or other identifying documents.
      5. Provide you with required notices, updates about our content, products and services as well as other important information; 
      6. Resolve disputes and/or questions about our Services;
      7. Problem troubleshooting, data analysis, testing, system maintenance, support, reporting and hosting data; 
      8. Communicate with you about content, products, services, updates, events, promotional offers, research, insights, and other information that may be of interest to you from us and our trusted partners;Customize, measure and improve our Services and content.
    2. For Marketing such as to market our goods and services or those of our Fanatics Family of Companies, business partners, and other third parties and to provide you with recommendations for content, products and services that we believe would be of interest to you.
    3. For Insights such as to identify trends and make inferences about you and your interactions with us, our Fanatics Family of Companies, such as to analyze your behavior and preferences and how you use and engage with our Services.
    4. To Comply With Legal Obligations and Defend Ourselves and Others, including:
      1. Enforce our Fanatics Family of Companies Terms for use of our Services and the terms of this Policy; 
      2. Protect our interests, including establishing, exercising and defending legal rights and claims; 
      3. Resolve disputes and/or questions about our Services;
      4. To comply with legal requirements, to prevent fraud, to co-operate with law enforcement and regulatory authorities, and to stop other prohibited, illegal, or harmful activities; and
      5. To help the government fight the funding of terrorism and money laundering activities, Federal law requires us to obtain, verify, and record information that identifies each person who opens an account.  What this means for you: When you open an account, we will ask for your name, address, date of birth and other information that will allow us to identify you. We may also ask to see your driver's license or other identifying documents.
    5. For Internal Business and Operational Purposes such as: 
      1. Managing customer accounts, including keeping general records of customers, purchases, bets, customer care, and other interactions;
      2. Problem troubleshooting, data analysis, testing, system maintenance, support, reporting and hosting data;
      3. Auditing related to our interactions with you;
      4. For security purposes, such as to respond to security incidents or to protect genuine customers and our business from fraud, to minimize the risk of false details being used, to avoid abuse by fraudsters, and to protect against other malicious, deceptive, fraudulent, infringing, or illegal activity; an
      5. Manage competitions or other promotions that you have chosen to participate in;
      6. Comply with contractual and other obligations.
    6. For Other Purposes disclosed at the time you provide/we request your information or as otherwise set forth in this Policy.
  5. Data Retention.   We will retain your Personal Data for as long as necessary to fulfill the purposes we have outlined to comply with applicable laws and regulations, and/or to support any claim, defense, or declaration in a case or before a jurisdictional and/or administrative authority, arbitration, or mediation panel. This includes, for example, retaining your Personal Data to provide you with the products or services you have requested and interact with you; maintain our business relationship with you; improve our business over time; ensure the ongoing legality, safety and security of our Services and relationships; or otherwise in accordance with our internal retention procedures.
  6. How We Disclose Personal Data
    1. Fanatics Family Companies.  We may disclose your Personal Data to our Fanatics Family of Companies, including affiliated entities, parents, and subsidiaries who may use the Personal Data for the purposes described herein. For example, our Family of Companies may exchange information about your interactions with our services, your preferences, and inferences we have drawn about you to customize offerings and market services to you. Further, Morton St. Trading Technologies, LLC (dba Fanatics Markets Tech) and FBG Enterprises Opco, LLC (dba Fanatics Betting & Gaming) provides support services for Fanatics Markets IB, including order flow, customer support, and other business services as set forth here and in the “Service Providers” section above.
    2. Service Providers.  We may use third-party service providers to perform certain business services and may disclose your information to such service providers as needed for them to perform these business services. Service providers are only allowed to use, disclose, or retain this information to provide these services. Business services provided include, but are not limited to, hosting services; account authentication and identity verification services;; marketing, promotional and email services; customer and technical support services; quality assurance testing, and back-office support services.
    3. Business Transactions. We may do business with third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then your information may be transferred to the new owners who may use your information in the same way as set out in this Policy.
    4. Legal Process. Subject to applicable law, we may disclose information about you i) if we are required to do so by law, regulation or legal process, such as a subpoena; ii) in response to requests by government entities, such as law enforcement authorities; iii) when we believe disclosure is necessary or appropriate to prevent physical, financial, or other harm, injury, or loss; iv) to otherwise establish, exercise, and defend against legal claims. or v) for the purposes of cooperation with law enforcement agencies’ and/or in connection with an investigation of suspected or actual unlawful activity
    5. Personal Data Shared for Targeted Advertising or Sold to Third Parties.  Fanatics Markets IB does not sell any Personal Data and has no actual knowledge of any sales or sharing of Personal Data of minors under 16 years of age. We have shared Personal Data with our third party advertising partners to serve ads to you about our Services as you browse the Internet (aka targeted advertising). This means that these third-party service providers may use their own cookies or tags to track your online activities and purchases in order to deliver targeted advertising based on your interests.  See “Your Privacy Rights” section below for information about opting out of this sharing.  We also work with third party business partners (“Business Partners”) and may disclose your personal data to them for their own purposes, such as for marketing or compliance purposes. Examples of Business Partners that might receive your personal data include but are not limited to (a) social networks, partners who work with us on promotional or sponsorship opportunities available through our Services; (b) other companies that may use the data to help us drive advertising-related revenue (including those who may have registered as a “data broker”); (c) content licensors, like the NFL, who may be involved in providing content that you may access through the Services; (d) market access partners or others with whom we work to provide Services in your region; (e) stadium operators; (f) sports leagues, teams, and governing bodies; as well as (g) partners who advertise on our sites or other sites to measure advertising effectiveness. Sharing with Business Partners may be considered selling personal data under certain state laws.  You may have the right to opt out of such disclosures, depending on where you live (See “Your Privacy Choices” below). However, we do not control how Business Partners use and share your information once they receive it. You will need to contact such Business Partners directly for information about their privacy practices or to exercise rights you may have (including if you would like to opt-out of receiving future emails from a Business Partner).
    6. User Disclosures. Information you include and transmit online in a publicly accessible blog, chat room, or Social Network, or that you share in an open forum such as an in-person panel or survey, or when sharing your experience on another website (such as Facebook, Instagram or X) may become public information and may be viewed and used by others without any restrictions. We do not control such uses of your Personal Data, and by using such services you assume the risk and acknowledge that the Personal Data provided by you may be viewed and used by third parties for any number of purposes and that the usage restrictions set forth in this Policy do not apply to such services.
  7. Communications and Opt-Out Depending on your marketing settings and preferences, we may use your information to let you know about our products, services and offers or other initiatives that may be of interest to you and we may contact you to do so by email, text or push notification.  Additional information about these marketing activities, including options for opting out are described below.  Email. We may send you emails concerning our products and services, as well as those of third parties. You may opt-out of promotional emails by following the unsubscribe instructions in a promotional email. This opt out will not apply to operational or informational emails related to your account such as correspondence providing information about your purchases or other such communications for which we have a legal obligation to inform you and/or to prevent fraud or harm to our Services, our business, and/or third parties. You may continue to receive promotional email messages for a short period while we process your request. Text Messaging.  We may send you marketing or other promotional text messages to the extent that you have provided the appropriate opt-in consent.  Standard text messaging charges applied by your cell phone carrier will apply to text messages we send. Your agreement to receive promotional texts is not a condition of any purchase or service. You may opt out of receiving text messages at any time by replying STOP to any text message you receive from us. You may continue to receive text messages for a short period while we process your request, and you may also receive text messages confirming the receipt of your opt-out request. Push Notifications. Where you have chosen at a device level to begin or continue receiving push notifications from us, we may send you push notifications relating to our products, services, offers and other marketing initiatives. You can choose to stop receiving push notifications from us at any time by changing your preferences on your mobile device.
  8. Third-Party Websites and Social Media Services
    1.  Third-Party Websites. The Services may contain links to other websites or Internet resources. When you click on one of those links, you are contacting another website or Internet resource. We have no responsibility or liability for, or control over, those other websites or resources or their collection, use and disclosure of your information, and this Policy does not apply to Personal Data collected through those websites or resources. We suggest that you read the privacy policy and terms of use of each such website.
    2. Social Media. Our Services may allow you to engage with social media services, such as Facebook, Twitter, Pinterest and Instagram (“Social Networks”), and widgets such as the "Share this" button, or interactive mini-programs that run on our Services or which link from Social Networks to our Services (“Social Functions”).  These Social Functions may access, collect, and integrate with your Social Network accounts and information. For example, these Social Functions may collect your IP address, identify which page you are visiting on our Services, or set a cookie.  We do not control those Social Networks or your profiles on those services. Nor do we modify your privacy settings on those services or establish rules about how your Personal Data on those services will be used. Social Functions are either hosted by a third party or hosted directly on our Services. Your interactions with them are governed by the privacy policy of the company providing them. Please refer to the privacy settings in your Social Network account to manage the data that is shared with us through your account. 
  9. Your Choices There are several ways in which you may opt out of the various programs and services we provide.
    1. Email. We may send you emails concerning our products and services, as well as those of third parties. You may opt-out of promotional emails by following the unsubscribe instructions in a promotional email. This opt out will not apply to operational or informational emails related to your account such as correspondence providing information about your purchases or other such communications for which we have a legal obligation to inform you and/or to prevent fraud or harm to our Services, our business, and/or third parties.     3. Push Notifications. Where you have chosen at a device level to begin or continue receiving push notifications from us, we may send you push notifications relating to our products, services, offers and other marketing initiatives. You can choose to stop receiving push notifications from us at any time by changing your preferences on your mobile device.
    4. Location Data Opt-Out. In some cases, you may also adjust the settings on your personal device or mobile device to allow or restrict the sharing of location information. For example, the "location" permissions on your personal device or mobile device may allow you to elect whether to never share location information with us, to share location information only while you are using the Services or always share location information even if you are not using the Services. If you elect to not share your location information, you may be unable to access certain features of our Services. Also, in the event that you prevent the sharing of location information, we may still estimate your general location based on the IP address you use to access Services.
  10. Security While we work to employ reasonable technical and organisational measures to safeguard the Personal Data that you provide to us, no transmission over the Internet can ever be guaranteed secure. Consequently, please note that we cannot guarantee the security of any Personal Data that you transfer over the Internet to us.
  11. Privacy of Minors The Services are intended for users aged twenty-one) and older. If you are under the age of twenty-one (21), you are not authorized to provide us with any personally identifying information, nor access or use our Services in any manner whatsoever. By using the Services, you represent that you are twenty-one (21) years of age or older. 
  12. Privacy Rights Depending on your jurisdiction of residence, you have certain rights with respect to your personal data. This section describes your privacy rights and explains how to exercise those rights.
    1. Right of Access and Portability.  You have the right to confirm whether or not Fanatics Markets IB is processing your Personal Data and to access such Personal Data up to two times per calendar year. This includes the right to know:
      1. The categories of Personal Data we collected about you.
      2. The categories of sources from which the Personal Data is collected.
      3. The categories of Personal Data sold or shared for purposes of cross-contextual advertising to a third party, as well as the categories of third parties to whom such Personal Data was sold or shared.
      4. The categories of Personal Data that the business disclosed about the consumer for a business purpose and the categories of persons to whom it was disclosed for a business purpose.
      5. Our business or commercial purpose for collecting, selling, or sharing for purposes of cross-contextual advertising your Personal Data.
      6. The specific pieces of Personal Data we collected about you. You also have the right, to the extent the information is available in a digital format, to obtain a copy of your Personal Data in a portable, and to the extent technically feasible, readily usable format that allows you to transmit the data to another controller without hindrance.  Oregon and Minnesota residents may also request a list of the specific third parties to which we have disclosed personal data.
    2. Right to Correct.  You may request that we correct inaccurate Personal Data we have collected from you, though we may need to verify the accuracy of the new data you provide to us. 
    3. Right to Delete.  You may request that we delete Personal Data we have collected from you under certain circumstances. Please note, that some information may not be eligible for deletion based upon applicable law or requirements of contracts.
    4. Right to Opt Out.  You have the right to opt out of processing Personal Data for the purposes of: (i) targeted advertising, (ii) the sale of Personal Data, or (iii) profiling in furtherance of a decision that produces a legal or similarly significant effect.
    5. Right to Limit Use and Disclosure.  California residents have the right to request that we limit the use and disclosure of sensitive Personal Data to specific business purposes approved by law. Our use of sensitive Personal Data is already limited to the approved business purposes identified above.
    6. Right to Withdraw Consent.  You have the right to withdraw your consent at any time where we are relying on consent to process your Personal Data.  If you withdraw your consent, we may not be able to provide certain products or services to you.
    7. Right to Non-Discrimination. Unless permitted by applicable law, we will not discriminate against you for exercising any of your privacy rights under applicable law, including by, but not limited to:
      1. Denying you goods or services;
      2. Charging you different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties;
      3. Providing you a different level of quality of goods or services; or
      4. Suggesting that you will receive a different price or rate for goods or services or a different level of quality of goods or services. Exercising Your Privacy Rights. Requests to know, correct, or delete can be submitted by calling our toll-free number 1-800-254-0320 or opt out of having your Personal Data shared to third parties for targeted marketing by clicking on the “Your Privacy Choices” link.  Additionally, if your browser supports it, you can turn on the Global Privacy Control (GPC) to opt-out of the sharing of your Personal Data for targeted online advertising. You can learn more about the GPC and how to enable it in your browser from the Global Privacy Control website.  Please note that only you, or an agent you authorize to act on your behalf may make a verifiable consumer request related to your Personal Data.  Authorizing an Agent to Act on Your Behalf. Where applicable and except where you have provided an agent with a Power of Attorney pursuant to Sections 4000 – 4465 of the California Probate Code, when using an authorized agent you must provide that person with written permission clearly describing their authority to make a request on your behalf. That agent must also be able to verify their identity with us and provide us with their authority to act on your behalf. An individual to whom you have provided Power of Attorney pursuant to applicable state rules may also make a request on your behalf. We may deny a request from an authorized agent if the agent does not provide us with the signed written permission demonstrating that they have been authorized to act on your behalf. Verifying your request. The verifiable consumer request initiated by your or your authorized agent must:
        • Include your full legal name, email and phone number, which we will need to contact you in order to verify that you are the person about whom we collected Personal Data or an authorized representative
        • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
        • If you are making the request as an authorized agent you must also provide; the full legal name of the party for which you are making the request and documentation for which your authorization is based.
        • We cannot respond to your request or provide you with your Personal Data if we cannot verify your identity or authority to make the request and confirm the Personal Data relates to you. Making a verifiable consumer request does not require you to create an account with us. One of our representatives will contact you in order to verify your identity. You may need to provide additional information in order to verify your request. We will only use Personal Data provided in a verifiable consumer request to verify the requestor's identity or authority to make the request. Response Timing and Format.  We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to ninety (90) days), we will inform you of the reason and extension period in writing.  We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request. Appeals.  Depending on applicable law, you may be able to appeal our decision to deny your request. If applicable you can file an appeal by following the instructions in the denial message. Exceptions.  These rights are not absolute and are subject to certain exceptions. For example, we cannot disclose or permit access to specific pieces of Personal Data if granting your request would present a certain level of risk to the security of the Personal Data at issue, your account with us or the security of our services. We may deny your deletion request if retaining the information under certain circumstances, for example, when it is necessary for us or our service providers to complete a contract or transaction with you or to comply with legal obligations.

Additional California Privacy Rights.   In addition to the rights identified above, California residents have the right to be informed of the following: California Civil Code Section 1798.83 permits California residents who have provided personally identifiable information to us or our third-party advertisers and marketing partners, if any, to request certain information regarding our disclosure of personally identifiable information to third parties for their own direct marketing purposes (if any).
