This Promotion May Not Be Used To Conduct, Advertise Or Promote Any Form Of Gambling.

The Fanatics ONE: Fanatics Markets IB Tier Points Launch Grant & Ongoing Tier Points Promotion (hereafter, "Promotion") is provided by Fanatics Loyalty, LLC., 8100 Nations Way, Jacksonville, FL 32256. A Fanatics ONE account is required to participate and can be obtained at no cost. Additional conditions apply to the registration of this account. The Promotion is offered in connection with, and is subject to the rules and policies of, Paragon Global Markets LLC d/b/a Fanatics Markets IB ("Fanatics Markets IB") and the Crypto.com | Derivatives North America exchange ("CDNA"). These terms and conditions supersede and replace any previous Fanatics Markets IB Tier Points promotions.

Eligibility

You must be eligible for and have or establish an account with Paragon Global Markets LLC d/b/a Fanatics Markets IB (an "Account") during the Promotion Period. You can create an Account for free. Note your identity must be verified to set up an Account. The Promotion is open to Fanatics Sportsbook customers in AZ, CO, CT, DC, IA, IL, IN, KS, KY, LA, MA, MD, MI, MO, NC, NJ, NY, OH, PA, TN, VA, VT, WV, or WY and Fanatics Markets IB customers in AL, AK, CA, DE, FL, GA, HI, ID, ME, MN, MS, NE, NH, NM, ND, OK, OR, RI, SC, SD, TX, UT, WA, US Virgin Islands, Puerto Rico, Guam and American Samoa who are twenty-one (21) years of age or older as of the date of registration. While a Sportsbook App account may be used to opt-in to the Promotion, a Fanatics Markets IB Account is required to complete the actions below required to earn Tier Points. Fanatics Markets IB accounts may only be accessed by individuals who are in AL, AK, CA, DE, FL, GA, HI, ID, ME, MN, MS, NE, NH, NM, ND, OK, OR, RI, SC, SD, TX, UT, WA, US Virgin Islands, Puerto Rico, Guam and American Samoa who are twenty-one (21) years of age or older.

This Promotion is not available to Individuals on any involuntary state gambling exclusion list, state gambling self-exclusion list, and/or self-exclusion list for any Sponsor subsidiary. Participants in the Promotion must be in good standing with all Fanatics entities with which the entrant has an account. This Promotion is not available to Individuals on any involuntary state gambling exclusion list, state gambling self-exclusion list, and/or self-exclusion list for any Sponsor affiliate. Employees, officers, directors, agents and representatives of Fanatics Loyalty, LLC (hereafter, "Fanatics"), and each of its respective parent companies, affiliates, owners, subsidiaries, shareholders, officers, directors, partners, agents, representatives and employees, both individually and collectively, and each of their respective parents, affiliates, subsidiaries, wholesalers, retailers, distributors, suppliers, advertising and promotion agencies (all of the following, hereafter collectively, "Released Parties") and each such individual's immediate family members (mother, father, sister, brother, child, spouse, regardless of where they reside) and those living in the same household, whether or not related, are not eligible to participate or receive a reward. Additionally, individuals who are employed by any local, state or federal government office or agency, elected officials and individuals listed on the OFAC Specially Designated Nationals and Blocked Persons (SDN) List are not eligible to participate or receive a reward. Void where prohibited by law. All applicable federal, state, and local laws apply.

Promotion Period

The Promotion begins at 12:00 a.m. Eastern Time ("ET") May 26, 2026 (the "Launch Date," currently anticipated to be on or around May 25, 2026), and ends at 11:59 p.m. ET on December 31, 2026 (the "Promotion Period"). The Promotion Period applies to Tier Point earning under this Promotion, and includes both the one-time Fanatics ONE Launch Grant described below and the ongoing Tier Point earning described below. If you previously opted-in to a prior iteration of this Promotion (including, without limitation, the prior weekly-credited Fanatics Markets IB Tier Points promotion), you will automatically be opted-in for this Promotion Period. Sponsor reserves the right to modify, suspend, extend or terminate the Promotion Period or any portion of the Promotion at any time and in its sole discretion, as further described under "Sponsor's Right to Modify or Terminate" below.

How to Earn Tier Points

During the Promotion Period, you will be opted in to Tier Point earning through Fanatics Markets IB through the Fanatics Sportsbook & Casino mobile app or the Fanatics Markets IB mobile app. California customers must opt-in manually. If you previously opted-in to a prior iteration of this Promotion, you will automatically be opted-in for this Promotion Period. Users may be prompted to complete a brief questionnaire to complete registration. You may earn Fanatics ONE Tier Points based on Qualifying Trades (defined below) made through your Account, as set forth below:

Qualifying Trade

A "Qualifying Trade" is a filled buy order for an event contract placed by an eligible customer on the Fanatics Markets IB platform that is funded from the customer's cash balance with Morton St. Trading Technologies, LLC d/b/a Fanatics Markets Tech. Trades funded in whole or in part by promotional credit, trading credit, bonus funds, Rewards from any other Fanatics offer, or any other non-cash funds are not Qualifying Trades. Trades that are not filled, are cancelled, or are voided will not be Qualifying Trades. Sponsor and Fanatics Markets IB reserve the right, in their sole discretion, to exclude from Qualifying Trades any trade or trading activity that they determine to be the product of self-matching, wash trading, manipulative or disruptive trading practices, error, fraud, abuse of this Promotion, or any violation of CDNA rules, the Fanatics Markets IB Terms of Use, or applicable law.

The Tier Point earning ladder set forth above (the "Earn Ladder") applies to all Tier Points earned under this Promotion, including under the Fanatics ONE Launch Grant described below. Sponsor reserves the right to modify the Earn Ladder, the eligible trades or trading activity, the contract price tiers, or any other element of Tier Point earning under this Promotion at any time and in its sole discretion, with such changes effective on a prospective basis upon posting of updated Promotional Terms and Conditions or other reasonable notice. Tier Points already credited will not be retroactively adjusted, except as required by applicable law or regulation. Past Tier Point earning rates under this or any prior promotion do not guarantee future Tier Point earning rates, and Sponsor makes no representation regarding the future value of Tier Points or the future availability of any particular Fanatics ONE Program benefits.

One-Time Fanatics ONE Launch Grant

In connection with the launch of Fanatics ONE Tier Point earning on Fanatics Markets IB, eligible customers will receive a one-time grant of Fanatics ONE Tier Points (the "Launch Grant") calculated based on their eligible trading activity on Fanatics Markets IB during the period beginning at 12:00 a.m. ET on January 1, 2026 and ending at 11:59 p.m. ET on the day immediately preceding the Launch Date (the "Look-Back Period"). To receive the Launch Grant, you must (i) be an eligible customer as described above as of the Launch Date, and (ii) have or establish a Fanatics ONE account. Only activity that would have qualified as Qualifying Trades (as defined above) had this Promotion been in effect during the Look-Back Period will be counted for purposes of the Launch Grant.

The Launch Grant for each eligible customer will equal the total Tier Points such customer would have earned during the Look-Back Period based on the customer's eligible trading activity on Fanatics Markets IB, applying the Earn Ladder set forth above, less any Tier Points previously credited to such customer under any prior iteration of the Fanatics Markets IB Tier Points promotion (including, without limitation, the weekly-credited promotion described at fanaticsmarkets.com/fanatics-one). The Launch Grant will not be less than zero; in no event will any previously credited Tier Points be reversed, clawed back or otherwise reduced as a result of the Launch Grant calculation. Customers who did not opt-in to any prior iteration will receive the full amount that would have been earned during the Look-Back Period under the Earn Ladder.

By way of illustrative example only (and not as any prediction or representation of any individual customer's actual Launch Grant): a customer who opted in to a prior iteration of the Promotion and was credited 10,000 Tier Points for activity backdated to a date later than January 1, 2026, and who would have earned 25,000 Tier Points under the Earn Ladder for the full Look-Back Period, would receive a Launch Grant of 15,000 Tier Points (i.e., 25,000 minus 10,000) for a total of 25,000 Tier Points credited across both promotions.

The Launch Grant will be credited to eligible Fanatics ONE accounts within sixty (60) days following the Launch Date. Sponsor and Fanatics Markets IB reserve the right, in their sole discretion, to determine which trades and trading activity qualify as eligible trading activity for purposes of the Look-Back Period, and to exclude any cancelled, voided, reversed, self-matched, wash, fraudulent, abusive, or otherwise non-bona-fide trading activity from the Launch Grant calculation.

Tier Point Crediting

Tier Points earned under the ongoing portion of this Promotion (i.e., other than the Launch Grant) will be credited on a weekly basis throughout the Promotion Period, and will be credited to eligible Fanatics ONE accounts within fourteen (14) days of each eligible Qualifying Trade. Tier Points credited in connection with a trade that is subsequently determined by Sponsor or Fanatics Markets IB not to have qualified as a Qualifying Trade (including, without limitation, due to cancellation, voiding, error, fraud, self-matching, wash trading, or other manipulative or disruptive practices) may be reversed or adjusted in Sponsor's sole discretion.

Sponsor's Right to Modify or Terminate

Sponsor reserves the right, in its sole discretion and at any time, to: (i) modify the Earn Ladder or any other element of Tier Point earning under this Promotion, including without limitation the contract price tiers, the rate at which Tier Points are earned per $100 in trade volume, the eligible trading activity, the eligible jurisdictions, and the opt-in mechanic; (ii) suspend the Promotion (in whole or in part); (iii) terminate the Promotion or any portion thereof prior to the scheduled end of the Promotion Period; and (iv) extend the Promotion Period beyond December 31, 2026. Any such modification, suspension, termination or extension will be effective on a prospective basis upon posting of updated Promotional Terms and Conditions or other reasonable notice (which may include in-app notification, email, or posting on the Fanatics Markets IB website). Tier Points already credited to a customer's Fanatics ONE account at the time of any such modification, suspension or termination will not be reduced, clawed back or otherwise adjusted, except (a) as required by applicable law or regulation, or (b) in the case of trades or activity that Sponsor or Fanatics Markets IB determines, in their sole discretion, were cancelled, voided, reversed, self-matched, wash, fraudulent, abusive, or otherwise non-bona-fide. Continued participation in the Promotion after any such modification constitutes acceptance of the updated Promotional Terms and Conditions.

General Reward Conditions

All federal, state and local taxes and all other costs associated with Tier Point acceptance and use not specified herein as being provided are the sole responsibility of the Tier Point recipients. Rewards will be provided "as is" with no warranty or guarantee, either express or implied by Fanatics. Tier Points may not be substituted, assigned, transferred, or redeemed for cash, but Fanatics reserves the right, at its sole discretion, to substitute a reward (or portion thereof) with one of comparable or greater value. Participation in this Promotion does not create any right or expectation that Tier Points will retain any particular value or that any specific Fanatics ONE Program benefit, redemption option, or reward will be available now or in the future.

General Conditions

The exchange that offers the markets for each event contract charges a separate exchange fee, of which Fanatics Markets IB receives a portion as commission. See https://fanaticsmarkets.com/legal/fee-schedule for the current schedule of fees, which may change from time to time.

By participating, each participant agrees: (a) to abide by these Promotional Terms and Conditions and decisions of Fanatics, which shall be final and binding in all respects relating to this Promotion; and (b) to release, discharge and hold harmless the Released Parties, from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from participant's participation in the Promotion or any Promotion-related activity or the acceptance, possession, use or misuse of any reward.

When participating in the Promotion, we collect personally identifying information about you, including your name and email address. The information that you provide will be added to a centralized Fanatics database. By participating and providing the required submission information, you acknowledge that Fanatics may email you information, promotional discounts or special offers it believes may be of interest to you. Your information will not be sold or rented to third parties. If you would like your information removed from this database you can do so at any time by following the opt-out instructions at the bottom of any email correspondence received from Fanatics. Miscellaneous

Persons who tamper with or abuse any aspect of the Promotion or website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Promotional Terms and Conditions, as solely determined by Fanatics, will be disqualified. Should any portion of the Promotion be, in Fanatics' sole opinion, compromised for any reason, including virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of Fanatics, corrupt or impair the administration, security, or fairness, Fanatics reserves the right at its sole discretion to suspend, modify or terminate the Promotion (or portion thereof). CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE, APP OR UNDERMINE THE LEGITIMATE OPERATION OF THE OFFER MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, FANATICS RESERVES THE RIGHT TO SEEK ANY AND ALL REMEDIES AVAILABLE FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

Arbitration

Except where prohibited by law, as a condition of participating in this Promotion, participant agrees that (1) any and all disputes and causes of action arising out of or connected with this Promotion, or any reward provided, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the participant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., costs associated with participating in this Promotion), and participant further waives all rights to have damages multiplied or increased.

Choice of Law

All issues and questions concerning the construction, validity, interpretation and enforceability of these Promotional Terms and Conditions, or the rights and obligations of participant and Fanatics in connection with the Promotion, shall be governed by, and construed in accordance with, the substantive laws of the State of New York, USA.
