Fanatics Markets Wallet Tech Privacy Policy

This Privacy Policy ("Policy") explains how Morton St Trading Technologies LLC d/b/a Fanatics Markets Tech ("Fanatics Markets Tech," "we," "our," or "us") collects, uses, discloses, and processes information related to your use of our website, mobile applications, social media accounts, digital platforms, and other online services (collectively, "Services"). The Services are intended for use in the U.S. in accordance with U.S. laws, the Terms of Service, and this Policy.

By "you" or "your," we mean any individual who interacts with or uses our Services. By accessing and using the Services, you agree to this Policy and consent to the collection, use, disclosure, and sharing of information as described. If you do not consent, do not use the Services.

By registering with Fanatics Markets IB, you create a Fanatics ONE account, usable across all Fanatics platforms. Your Fanatics ONE account is subject to the Fanatics ONE Privacy Policy.

1. Personal Data We Collect

We may collect, use, store, and disclose information linked or reasonably linkable to an identified or identifiable individual ("Personal Data"). The information collected depends on your interactions with the Services.

  • Identifiers:name, online identifier, gender, profession, social security number, driver's license number, passport number, or other government-issued ID.
  • Contact Information: email address, mailing address, telephone numbers.
  • Financial Information: bank account and payment card details, account balances, transaction history, credit history, tax information, credit scores.
  • Profile Data: username and password, interests and preferences.
  • Commercial Information: records of products or services purchased, obtained, or considered; trades; survey responses; purchasing or consuming histories or tendencies.
  • Characteristics of Protected Classifications: age or date of birth, national origin, citizenship.
  • Biometric Information: faceprints (face geometry) to verify identity, collected by our vendor; treated as sensitive Personal Data.
  • Usage Data: statistics on email opens and clicks; website activity (time spent, user stats, referring/exit pages, clickstream data); other engagement data.
  • Internet or Network Activity: browsing history, search history, interactions with websites, apps, or ads; IP address; browser type/version; time zone and location; plug-ins; OS and device details.
  • Marketing and Communications Data: campaign data, click-throughs, marketing preferences, communication preferences, email and chat communications.
  • Audio and Visual Information: audio/video recordings, photographs.
  • Location Data: precise geolocation via GPS, Wi-Fi, triangulation, or other methods.
  • Inference Data: inferences drawn from Personal Data above.
  • Sensitive Personal Data:social security number; driver's license; passport; other government ID; national origin; citizenship; precise geolocation; biometric information.

We do not use or disclose sensitive Personal Data beyond purposes permitted by law (e.g., providing goods/services, verifying identity, processing payments, ensuring security, complying with legal requirements).

2. Biometric Information Policy

Fanatics Markets IB uses third-party vendors (including Socure or Aristotle, depending on your state) to collect, store, and use biometric information (faceprints), together with a selfie and government-issued ID.

By using the Services, you consent to Fanatics Markets IB, our identity verification vendors, and service providers collecting, storing, and using your biometric information for:

  • Verifying your identity
  • Preventing fraud
  • Improving products and services
  • Complying with legal obligations

Data Retention: Biometric information will be securely deleted no later than 3 years after your last interaction with us or our vendor, whichever is earlier, unless legal obligations require longer retention.

3. How We Collect Personal Data

We collect Personal Data from various sources and methods:

Directly from You: when you create/verify an account; purchase goods/services; participate in promotions, surveys, or contests; communicate with us; make deposits/withdrawals; engage with the Fanatics Family of Companies; or complete forms and share data.

Information Collected During Use:

  • Automated technologies: IP address, browser type, ISP, referring/exit pages, OS, date/time stamp, time zone and location, language, device type and ID, and other technical information.
  • Cookies and Tracking: cookies, pixels, and other tech recognize your device and remember activity. You may adjust browser settings to warn or turn off cookies; some site features may not function without cookies. You can opt out of targeted ads via the Network Advertising Initiative (NAI) or the Digital Advertising Alliance (DAA). Pixel tags register visits and email opens; disabling images in email may reduce tracking.
  • Analytics: Google Analytics collects IP and usage data (time on page, pages visited, websites before/after). Google may use this to show more relevant ads across properties and the web. Information from Third Parties:

  • Service Providers: payment processors, email service providers, hosting platforms, identity verification, analytics, geolocation.
  • Social Media Services: Google or Apple login may provide public profile information and email.
  • Advertising Partners: data from ad platforms combined with analytics.
  • Data Brokers: contact details, demographics, commercial preferences, online activity; used for customer understanding, tailoring services/marketing, fraud detection/prevention, and other business purposes.
  • Publicly Available Sources: government/public sources; social media platforms and networks.

Under applicable laws, you may have rights to know categories collected from third parties, request copies, or opt out of "sale" or "sharing." See Privacy Rights.

4. How We Use Personal Data

Primary purpose: provide products and services. Additional uses include marketing Fanatics Family of Companies, partners, and third-party services; identifying trends and insights; legal compliance and defense; and internal business operations.

5. Data Retention

We retain Personal Data as long as necessary to fulfill purposes outlined, comply with laws/regulations, and support claims or defenses in legal or administrative proceedings, arbitration, or mediation. This includes retention to provide requested services, maintain relationships, improve the business, ensure legality, safety, and security, and per internal retention procedures.

6. How We Disclose Personal Data

  • Fanatics Family of Companies: affiliated entities, parents, and subsidiaries may use Personal Data as described; exchange information on interactions, preferences, and inferences to customize offerings and market services. Fanatics Markets Tech and FBG Enterprises Opco, LLC (d/b/a Fanatics Betting & Gaming) provide support services including payment processing, wallets, customer support, and other business services.
  • Service Providers: hosting; authentication and identity verification; billing/accounting; payment processing; marketing, promotional, and email services; customer/technical support; quality assurance testing; back-office support. Use limited to providing services.
  • Business Transactions: in mergers, acquisitions, sales, or transfers, information may be transferred to new owners for use consistent with this Policy.
  • Legal Process: disclosure as required by law, regulation, or legal process (e.g., subpoena); in response to government requests; to prevent harm or loss; to establish, exercise, or defend legal claims; to cooperate with law enforcement and investigations of suspected unlawful activity.
  • Targeted Advertising or Sale/Share: we do not sell Personal Data and have no actual knowledge of sales/sharing of Personal Data of minors under 16. We have shared Personal Data with third-party advertising partners for targeted ads. You may opt out. We may disclose Personal Data to Business Partners (e.g., social networks, sponsorship partners, data brokers, content licensors like the NFL, market access partners, stadium operators, sports leagues/teams/governing bodies, advertisers measuring effectiveness). Sharing with Business Partners may be considered selling under certain state laws. Contact Business Partners directly for their practices and rights.
  • User Disclosures: content you post or share publicly may become public and used by others without restriction.

7. Communications and Opt-Out

  • Email: opt out of promotional emails via unsubscribe; operational/account emails may continue for legal, security, or transactional reasons.
  • Text Messaging: if opted in, you may opt out by replying STOP; carrier charges may apply; brief period may occur during processing; confirmation texts may be sent.
  • Push Notifications: adjust device settings to stop receiving push notifications.

8. Third-Party Websites and Social Media Services

  • Third-Party Websites: links may direct to external sites; this Policy does not apply to those sites. Review their privacy policies.
  • Social Media:"Social Networks" and "Social Functions" may collect data (e.g., IP address, page visited, cookies) and integrate with your accounts. Interactions are governed by the providers' policies. Manage sharing via your social account settings.

9. Your Choices

  • Email: opt out via unsubscribe in promotional emails; operational/account emails may continue; allow processing time.
  • Text Messaging: opt out by replying STOP; allow processing time; confirmation texts may be sent.
  • Push Notifications: change preferences on your device.
  • Location Data Opt-Out: adjust device-level location permissions. Without sharing location, some features may be unavailable. We may still estimate general location via IP address.

10. Security

We employ reasonable technical and organizational measures to safeguard Personal Data, but Internet transmission cannot be guaranteed secure. We cannot guarantee the security of Personal Data transferred over the Internet.

11. Privacy of Minors

Services are intended for users aged 21 and older. If you are under 21, you are not authorized to provide personally identifying information or use the Services. By using the Services, you represent you are 21 or older.

12. Privacy Rights

Depending on your jurisdiction, you have rights regarding your Personal Data:

  • Right of Access and Portability: confirm processing; access categories collected, sources, categories sold/shared for advertising and third parties receiving such data, categories disclosed for business purposes and recipients, business/commercial purposes, and specific pieces collected. Obtain a portable, readily usable copy where technically feasible. Oregon and Minnesota residents may request a list of specific third parties to whom data was disclosed.
  • Right to Correct: request correction of inaccurate Personal Data; we may verify new data accuracy.
  • Right to Delete: request deletion under certain circumstances; some information may be retained under law or contracts.
  • Right to Opt Out: opt out of targeted advertising, sale of Personal Data, or profiling producing legal or similarly significant effects.
  • Right to Limit Use/Disclosure: California residents may request limits on sensitive Personal Data; our use is already limited to approved purposes.
  • Right to Withdraw Consent: withdraw consent where processing relies on consent; some products/services may not be available afterward.
  • Right to Non-Discrimination: we will not discriminate for exercising privacy rights (e.g., denying goods/services; different prices/rates; different quality levels; suggesting different prices/quality).

Exercising Your Rights

Submit requests to know, correct, or delete by calling 1-800-254-0320 or opt out of sharing for targeted marketing via the "Your Privacy Choices" link. You can also enable Global Privacy Control (GPC) in your browser to opt out of targeted online advertising.

Authorized Agents

If using an agent (without a Power of Attorney), provide written permission describing authority and allow the agent to verify identity and authority. Agents with Power of Attorney may act per applicable rules. We may deny requests without proper authorization.

Verification

Include your full legal name, email, and phone number; describe your request in sufficient detail; agents must provide the principal's full legal name and authorization documentation. We cannot respond if we cannot verify identity/authority and confirm the data relates to you. You need not create an account. Our representative will contact you and may request additional information solely to verify the request.

Response Timing and Format

We aim to respond within 45 days; if more time is needed (up to 90 days), we will inform you in writing. No fee unless the request is excessive, repetitive, or unfounded; if a fee applies, we will provide a cost estimate before processing.

Appeals

If applicable by law, you may appeal a denial following instructions in the denial message.

Exceptions

Rights are subject to exceptions (e.g., security risks, completion of contracts/transactions, legal obligations).

Additional California Privacy Rights

California Civil Code §1798.83 allows California residents who provided personally identifiable information to us or our third-party advertisers/marketing partners to request details about disclosures for direct marketing purposes (if any). Email [email protected] with "CALIFORNIA PRIVACY RIGHTS" in the subject line. Not all sharing is covered; responses include covered sharing only. One request per calendar year.

Do Not Track (DNT)

Many sites (including ours) do not respond to DNT signals due to lack of uniform standards. Certain third-party advertising partners may place tracking technology (cookies, pixels) on our Services to collect identifiable information across sites over time. By using the Services, you consent to such tracking technologies.

Categories of Personal Data Disclosed, Sold, or Shared in the Preceding 12 Months

  • Identifiers: disclosed to Fanatics Family of Companies; service providers; entities in business transactions; law enforcement/government for legal/security/safety; shared with third-party advertising partners and business partners.
  • Personal Information in Customer Records: disclosed as above; shared with third-party advertising partners and business partners.
  • Protected Class Characteristics: disclosed as above; shared with third-party advertising partners and business partners.

13. Other Notices and Important Information

  • Privacy Policy Changes: we may update this Policy and will revise the effective date. Continued use after changes signifies acceptance. We may notify of material changes.
  • Notice to International Users: Services are for U.S. residents. Information may be transferred to and stored in the U.S., which may have less protective laws. Data stored in the U.S. may be subject to lawful requests by courts or law enforcement.
